This Comprehensive Privacy Notice (the “Notice”) is addressed to the user (the “Holder” or “You”) of the digital market for the purchase and sale of merchandise whose ownership corresponds to PLANT SQUAD MEXICO SAPI de CV (the “Platform” ). You may access this Notice at any time as it is made available to you on the Plant Squad Market website (www.plantsquad.com) (the “Website”).

I.- Definitions.

Except for the terms defined in various sections of this Notice or in the Law, the terms that appear with the first letter in capital letters, within this Notice, will have the meanings assigned to them below:

Banking Aggregator.- Refers to the specialized company that has been contracted by the Controller to process payments made by bank card by the Holder.

Warning

This privacy notice, whether issued in a physical or electronic document or in any other format generated by the Responsible Party that is made available to the Owner, prior to the Processing of their Personal Data.

Personal information

Any information concerning an identified or identifiable natural person.

Sensitive Personal Data

Those Personal Data that affect the most intimate sphere of its Owner, or whose improper use may give rise to discrimination or entail a serious risk for it. In particular, those that may reveal aspects such as racial or ethnic origin, present and future state of health, genetic information, religious, philosophical and moral beliefs, union affiliation, political opinions or sexual preference are considered sensitive.

Rights "ARCO"

It refers to the set of prerogatives that the Owner has before the Responsible, in relation to their Personal Data, which consist of the following in summary: the right to access their Personal Data and the details of their treatment; as well as to rectify them in case they are inaccurate; cancel them when you consider that they are excessive or unnecessary for the purposes that justified their obtaining; and oppose their treatment for specific purposes.

In charge

It refers, jointly, to the Website and the Application.

Private natural or moral person who carries out the processing of Personal Data.

II.- Identity and address of the Responsible.

Grupo Gourmand SA de CV, with address at Calle Berlin, Number 222-B, Colonia Del Carmen, Postal Code 04100, Alcaldía Coyoacan, Mexico City, will be responsible for the Processing of Personal Data (hereinafter, the "Responsible" or " Plant Squad Market”). The Responsible may be assisted by one or more Managers, who will act in the name and on behalf of the Responsible, to provide a more efficient Treatment of Personal Data. The Managers will be informed of the due treatment that they must provide to the Personal Data.

III. Personal Data that will be processed.

This Notice will be made available to the Owner directly in the Application, in electronic format. You will consent to the Processing of your Personal Data before Plant Squad Market through the express acceptance of this Notice, through the boxes expressly enabled in the Digital Media for this purpose during the registration process of the Owner as a user. The marking of the boxes or acceptance buttons presuppose that the Owner has read and expressly accepted what is provided herein. Plant Squad Market expressly and directly obtains the Personal Data that you provide us in order to proceed with the registration, installation, access and use of the Digital Media. Specifically, the Controller will directly collect the following personal data from the Owner:

1. Full name.

2. Email address.

3. Password.

4. Mobile phone number.

5. Delivery address.

6. Information of the chosen means of payment.

7. In the event that the User chooses the option of linked access through social network accounts or through Gmail®, the data related to said linked access.

When you use the Digital Media, we collect certain information automatically and indirectly. The personal data that we can get to know thanks to the use you make of the Platform are the following:

1. Location in real time, through georeferencing tools.

2. IP adress.

3. The version of the Application that you have downloaded.

4. Statistical information on the use and browsing of the Application.

5. The hardware, software and internet browser you use.

1. Financial Personal Data.

The Responsible declares that the collections will be made through a Banking Aggregator. Therefore, Plant Squad Market will direct the information corresponding to the means of payment that you have designated directly to the Ban Aggregator. The Bank Aggregators will capture and process, in a private and restricted manner, the personal financial or banking data of the Responsible party that is exclusively necessary to carry out the Collection of the Service through a bank card or electronic means of payment. Currently, Plant Squad Market does not store or maintain any kind of financial data, since the Provider uses the Gateway services and/or acceptance of electronic payments provided by Bank Aggregators.

The Holder is informed that, to date, he is connected to the Platform: Paypal (commercial name: Paypal)

1. Sensitive Personal Data.

Sensitive Personal Data is considered to be those Personal Data that affect the most intimate sphere of its Owner, or whose improper use may give rise to discrimination or entail a serious risk for it. By virtue of the foregoing, Plant Squad Market will at no time collect or store Sensitive Personal Data.

1. Primary purposes of the Treatment.

The Personal Data collected by Plant Squad Market is used to manage the acquisition of Products and the processing of Orders on the Platform. The primary purposes of the Treatment are the following:

1. Manage the creation of your user account and allow you to use or modify it. To use the Platform, it is necessary that you have an account enabled and that you identify yourself as a user. You can modify the Personal Data that you have provided us at any time through the corresponding section.

2. Allow you to purchase Products through the Platform.

3. Coordinate the delivery of your Orders, as well as process any requests related to an Order (eg cancellations, returns, clarifications or refunds).

4. Contact you to give you information regarding an Order in progress.

5. Manage payments for your Orders.

6. Allow you to consult a history of all the Orders you have made.

7. Provide you, through the email address that you have provided us with, the receipts or invoices corresponding to the Orders you have placed.

9. To prevent potential fraud against the Owner and against Plant Squad Market, for which we can ask you to validate your account by entering a code that you will receive by SMS or by any other means of authentication.

Compliance with the primary purposes of the Treatment is necessary for the existence, maintenance and fulfillment of the legal relationship between the Responsible Party and the Holder.

VII. Secondary purposes of the Treatment.

1. To carry out actions for marketing, publicity or commercial prospecting purposes.

2. To consult your opinion statistically. In the event that you do not want your Personal Data to be processed for any or all of the secondary purposes, from this moment you can notify us of the above through the means provided in the Contact Section.

VIII. Transfers of Personal Data.

To comply with the purposes described above or other those legally required, Plant Squad Market may transfer your Personal Data to the companies that are part of the Plant Squad Market corporate group, that is, to the parent companies, controllers, subsidiaries and affiliates of the Respondent. Based on article 37 of the Law, we inform you that obtaining your consent will not be required to make Transfers to holding companies, subsidiaries or affiliates, or to a parent company or to any company in the same group of Plant Squad Market, whenever said companies are governed by the same privacy standards.

1. Rights "ARCO" regarding the protection of Personal Data.

The "ARCO" Rights are an acronym that groups four rights that the Owner can exercise, in relation to their Personal Data:

1. Access the Personal Data that is subject to Treatment; that is, request the Responsible to allow the Holder to know what data is in his possession.

2. Rectify any of the Personal Data, subject to Treatment and in the possession of the Responsible Party, that is inaccurate, incomplete, erroneous and/or imprecise.

3. Cancel any of the Personal Data, in the possession of the Responsible, who legitimately considers that they are not being used to fulfill any of the purposes of the Treatment and/or that they are being used in contravention of the Law, the Regulation or any other legal provision. applicable.

4. Oppose the Treatment carried out by the Responsible, with justified cause, provided that it may cause you any damage and/or harm, or that it is contrary to the Law, the Regulation or any other applicable legal provision.

For this purpose, the Holder must send a request with, at least, the following requirements:

1. The name of the Owner and address or other means to communicate the response to your request;

2. The documents that prove the identity or, where appropriate, the legal representation of the Holder;

3. The clear and precise description of the Personal Data with respect to which one seeks to exercise any of the aforementioned rights;

4. The modality by which you wish to obtain a response, that is, in writing, in electronic documents or any other means.

The request to exercise "ARCO" Rights must be sent to any of the means indicated in the Contact Section. Once the request is received, the Responsible will have a period of fifteen (15) calendar days to respond to the Owner of the Personal Data, which will be sent through the response method designated by the Owner. This period may be extended with prior notice only once for an equal period, as long as the extension is justified. Notwithstanding the foregoing, you will also have the right to request Plant Squad Market to send you an ARCO Rights Form that is easy to fill out, in order to exercise any of the prerogatives provided herein.

1. Mechanism to express the Owner's refusal to Process their Personal Data.

You have the right to revoke the consent you have given for the processing, either in relation to one or all of your Personal Data. For this purpose, the Holder must send a request with, at least, the following requirements:

1. The name of the Owner and address or other means to communicate the response to your request;

2. The documents that prove the identity or, where appropriate, the legal representation of the Holder;

3. The clear and precise description of the Personal Data with respect to which it is sought to express the refusal regarding its Treatment;

4. The modality by which you wish to obtain a response, that is, in writing, in electronic documents or any other means.

The request for revocation of consent must be sent to any of the means indicated in the Contact Section. Once the request is received, the Responsible will have a period of fifteen (15) calendar days to respond to the Owner of the Personal Data, which will be sent through the response method designated by the Owner. The revocation of consent related to Personal Data that is essential for Plant Squad Market to grant you access to the Platform will imply that the Controller will not be obliged to enable said access, because they are prevented from doing so.

1. Options and means to limit the use or disclosure of your Personal Data.

The Holder can indicate to the Manager that he wishes to limit or stop receiving advertising messages, whether by landline or cell phone, as well as by email. You may limit the use or disclosure of your Personal Data by sending a request to the Contact Section of the Responsible. For this purpose, the Holder must send a request with, at least, the following requirements:

1. The name of the Owner and address or other means to communicate the response to your request;

2. The documents that prove the identity or, where appropriate, the legal representation of the Holder;

3. The clear and precise description of the Personal Data with respect to which it is sought to limit the use or disclosure.

In addition, we inform the Holder that he can register with the Public Registry of Users (REUS) or the Public Registry to Avoid Publicity (REPEP) that for the purpose of limiting the use or disclosure of personal information is kept by the competent authorities.

1. Through an email to the account that the User has registered;

2. Publishing it in Digital Media.

The Responsible reserves the right to change and update this Notice, the Holder will be responsible for keeping his email account updated and making sure that notifications are received in a mailbox that is constantly reviewed. In case of not receiving opposition from the Holder within a period of seventy-two (72) hours, it will be understood that he accepts in accordance with the changes that this Notice may undergo. We suggest you check the last modification date of this document.
